This sweepstakes is sponsored by [FOX Kansas, 316 N. West Street, Wichita, KS 67203 and Shelter Insurance agents] ([collectively,] “Sponsor”). Sweepstakes is void where prohibited. By entering, each entrant accepts and agrees to be bound by these Official Rules.
HOW TO ENTER: No purchase is necessary to enter or win this Sweepstakes. The Sweepstakes begins on [June 22, 2011] and ends on [December 31, 2012] (the “Entry Period”). Entrants may enter this Sweepstakes by: [registering online at www.foxkansas.com]. One winner will be drawn each day beginning July 4th 2011, through the end of the contest period. There is no fee to enter.
All entrants will be required to provide their [name, mailing address, phone number and email address]. All entries become the property of Sponsor, and Sponsor reserves the right to use any information submitted by entrants. Entrants acknowledge and accept that their information may be used by Sponsor to send additional marketing and promotional offers. Sponsor is not responsible for lost, late, illegible, misdirected or mutilated entries, including due to technical/network failures, human error, or any other error or malfunction. Entry materials that have been tampered with or altered are void.

The authorized account holder of the e-mail address submitted at time of entry will be considered the entrant. An “authorized account holder” shall mean the natural person assigned to such e-mail account by the Internet access provider, online service provider, or other organization responsible for assigning e-mail addresses for the domain associated with such e-mail account. A potential winner may be requested to provide proof that he or she is the authorized account holder of the e-mail address associated with a winning entry.
Entrants agree not to upload, post or transmit any materials which contain any computer viruses, Easter eggs, worms, Trojan Horses or other harmful component or programming routines that are intended to damage, detrimentally interfere with, surreptitiously intercept or expropriate any system, data or personal information. Any attempt to deliberately damage any web site or undermine the operation of the Contest is a violation of criminal and civil laws, and Sponsor reserves the right to seek damages from any person who makes such attempt(s).]
ELIGIBILITY: This Sweepstakes is open only to legal residents of [Kansas] who are [18] years of age or older at time of entry. Sweepstakes is void [in state(s) outside of Kansas and] where prohibited or restricted by law. Employees of Sponsor and their family members or persons living in the same households of such individuals are not eligible to participate in this Sweepstakes. All federal, state, and local laws apply. Winner will be required to sign an affidavit of eligibility (except where prohibited) affirming his or her agreement to all terms, conditions, and restrictions in these Sweepstakes rules.
PRIZES: [1] GRAND PRIZE[S] will be awarded each night during the FOX Kansas Eyewitness News at Nine Weather. The Grand Prize will include: [one FOX Kansas/Shelter Insurance Weather Umbrella] (the “Grand Prize”). The total retail value of the Grand Prize is approximately $[25]. Actual retail value may vary. Winner will not receive difference between actual and approximate retail value. The Grand Prize may not be exchanged or redeemed for cash, sold, or traded. No prize transfer, assignment, or substitution by Winner is permitted. Sponsor reserves the right to substitute a prize, in which case a prize of equal or greater value will be awarded.
Winner must accept the Grand Prize as awarded. Each prize is non-transferable and may not be exchanged for cash or any other consideration. [Weather umbrellas must be claimed at the FOX Kansas business office located at 316 N. West Street, Wichita, KS 67203. Due to the larger size of the umbrellas, the prize will not be mailed to the winner.]
SWEEPSTAKES RANDOM DRAWING: Sponsor will select [1] Grand Prize Winner[s] from among all eligible entries by random drawing on or before [drawing date and time]. Odds of winning depend upon the number of eligible entries received. The person[s] selected as the winner of a prize ([each a] “Winner”) will be notified by [announcing their name on-air during the FOX Kansas Eyewitness News at Nine weather segment and by the station via email]. If any attempted notification is not successful within [30] days, the prize will be forfeited and Sponsor reserves the right to randomly select an alternate winner from among the remaining eligible entries.
CONDITIONS AND RESTRICTIONS APPLY: Winner must continue to comply with all terms and conditions of these Official Rules, and winning is contingent upon fulfilling all requirements. Upon request from Sponsor, entrants must promptly furnish proof of legal U.S. residency, legal age, and eligibility to enter the Sweepstakes. An entrant’s failure promptly to comply with such a request will result in the entrant’s disqualification. Winner is subject to verification by Sponsor, whose decisions are final and binding in all matters related to the Sweepstakes. An entrant is not a winner of any prize unless and until entrant’s eligibility has been verified and entrant has been notified that verification is complete. In the event that a winner is determined to be ineligible, the prize will be forfeited and Sponsor reserves the right to randomly select an alternate winner from among the remaining eligible entries. In the event that a winner is determined to be ineligible or fails to respond to Sponsor within five (5) days of Sponsor’s first attempted notification, the Prize will be forfeited and Sponsor reserves the right to randomly select an alternate winner from among the remaining eligible entries. Sponsor reserves the right to terminate the Sweepstakes without awarding the Grand Prize if no eligible winner or alternate winner claims the prize within the required time period.
Winner will be required to execute and return to Sponsor a liability release and affidavit of eligibility without modification (except where prohibited) within [30] days of notice of winning. In the event that Winner fails to execute and return a liability release and affidavit of eligibility (except where prohibited) within [30] days of notice of winning, or in the event that Winner returns the release and affidavit form with modifications, Winner’s prize may be forfeited and Sponsor may randomly select an alternate winner from among the remaining eligible entries.
Winner will be solely responsible for any and all local, state, and federal taxes. Sponsor will report any individual winnings over $600 (in cash or fair market value of goods or services) in a one-year period to the Internal Revenue Service. Winner will receive a Form 1099 from Sponsor if Sponsor report any winnings to the Internal Revenue Service.
Winner agrees to the use of his/her name and/or likeness in further promotional materials and press releases by Sponsor without any additional compensation (except where prohibited). By entering this Sweepstakes, Winner agrees that Sponsor has the right without notice or further compensation to publicize, by any medium, Winner’s name, voice, image, and likeness, the fact that Winner won, and all matters incidental thereto. Winner agrees to execute any additional liability or publicity release agreements requested by Sponsor.
LIMITATION ON LIABILITY: Sponsor will not be responsible for lost, late, damaged, defaced, incomplete, stolen, illegible, indiscernible, mutilated, illegally obtained, postage due or misdirected entries or for any typographical, or other error in the printing of the offer, administration of the Sweepstakes, or announcement of the prizes and/or all Sweepstakes-related materials. By entering this Sweepstakes, each entrant forever discharges, releases, and holds harmless Sponsor, and each of its parent companies, subsidiaries, affiliates, and each of [its/their] respective directors, officers, employees, and agents from any and all liability, claims, losses, damages, causes of action, suits, and demands of any kind arising from or in connection with the Sweepstakes, including, without limitation, responsibility for property damage, loss of life, or personal injury resulting from or in connection with participating in the Sweepstakes or from or in connection with use or receipt of the Grand Prize, however caused.
RELEASE OF LIABILITY: By participating in the Sweepstakes, each participant waives any and all claims of liability against Sponsor and its affiliates, employees and agents for any personal injury or loss which may occur from the conduct of, or participation in, the Sweepstakes, or from the use of any prize.
SPONSOR’S RESERVATION OF RIGHTS: These Official Rules are subject to modification by Sponsor. In the event of a dispute, all decisions made by Sponsor are final and binding. Sponsor reserves the right, in its sole discretion, to disqualify any person who tampers with or abuses the entry process, or who otherwise acts in violation of these Official Rules. Sponsor further reserves the right, in its sole discretion, to cancel, terminate, or modify this Sweepstakes if, for any reason, the Sweepstakes is not capable of completion as planned, including due to force majeure or non-authorized human intervention that compromises or affects the administration, fairness, integrity, or proper conduct of the Sweepstakes.
WINNER LIST: For the name of Winner(s), after [December 31, 2012] send written request identifying this promotion as [Weather Umbrella Contest] and a self-addressed stamped envelope to: [FOX Kansas, Attn: Promotions Director, 316 N. West Street, Wichita, KS 67203]. Requests received more than sixty (60) days after [December 31, 2012] will not be honored.
