My name is Nathan Clift. I own property in Winfield, Kansas. My mortgage is through US Bank Home Mortgage. I have been having problems with US Bank since the beginning of 2010. I have been paying my mortgage within the month it is due, every month. US Bank has been sending me HUD Home pamphlets along with numerous letters saying I am behind nine months in my payments. I am not behind and have proof that I have made those payments every month. My community bank has indicated to me that my credit score has dropped over 200 points due to my alleged non-payment. US Bank says they have not been receiving my payments but I receive phone calls from their billing department telling me that I am not in default and only owe $900. This shows me that this bank is so large that they do not even communicate with their billing departments. I have a great track record with keeping up with my bills and my community bank can vouch for that. I am at a point with US Bank that seems beyond my power to rectify. I had contacted state representatives at the time Steve Six and Todd Tiehart as well as Sam Brownback. I have since hired a lawyer to fight US Bank in this matter.
I am a first time home owner and this whole situation has made me not want to own another home of my own. US Bank recently hired a company to install new locks on every entrance to the home and garage without me or my attorney’s permission and did not even contact us about this before doing so. The property has only been vacant for 3 weeks when they locked me out. I still have things to remove from the property but when my lawyer asked about it US Banks lawyer just responded by saying that they were protecting their interest in the property. Since being locked out of the property, (that has not even been foreclosed on yet) I have lost a potential buyer because we could not get in to clean the property or have access to show it. My credit score has dropped over 200 points and I don’t believe that I will recover any of those points even though I have proof of making the payments. I even had an offer on the property but US Bank said it was $5300 shy of the amount that they would accept.
I believe that this large bank would rather win no matter the cost or they would have realized that the housing market in Winfield Kansas is not doing well and would have accepted the only offer for the property in almost 3 years. I don’t expect to win this situation but I wanted to send this letter out to you so that maybe a story could be done on this matter that is affecting so many Kansans and Americans today. It is a shame that these large banks are getting away with things like this and causing young homeowners like myself to never want to purchase another property. I don’t understand it, but I am being punished for paying my bills. Thank you for your time and I hope that this is something that may be of interest to you.
